Birdfy Warranty Policy
1. Scope of Policy
This policy applies to Birdfy-branded smart birdwatching cameras, add-ons, and related derivative products (hereinafter collectively referred to as "products") purchased through the official Birdfy website, authorized e-commerce platforms, and authorized retail partners. To be eligible for a return, a valid proof of purchase (e.g., sales receipt, order confirmation screenshot) is required. This policy does not apply to products purchased from unauthorized third-party channels.
2. Return and Exchange Terms
(a) Returns, Refunds & Exchanges (Within 30 Days)
- Return & Refund Window: 30 days from the date of receipt.
- Exchange Window: 30 days from the date of receipt.

Shipping Fees:
- Non-Quality Related Returns: The customer is responsible for all return shipping costs.
- Non-Quality Related Exchanges: The customer is responsible for one-way shipping costs (sending the original product back to Birdfy).
- Quality-Related Issues: Birdfy will cover all shipping costs for returns or exchanges caused by product defects or quality issues.
(b) Eligibility Requirements
To qualify for a return or exchange, the following conditions must be met:
- Complete Package: The product must be returned in its original packaging, including all accessories (e.g., chargers, cables, manuals) and any promotional gifts included with the original order.
- Intact Identification: All product labels, including the QR code and serial number on the device, must be intact and legible.

(c) Return & Exchange Process (Within 30 Days)
- How to Initiate: Please visit the Contact Us page on our website to submit a return or refund request. Our Customer Support team will review your inquiry and respond within 24 hours.

- Order information (e.g., Order Number)
- Device ID
- Description of the product issue
- Reason for the return or exchange
- A copy of the valid proof of purchase
(d) Authorized E-Commerce Platform Policies
- Platform Priority: For products purchased through Birdfy-authorized e-commerce platforms (including, but not limited to, Amazon and Walmart), all return and exchange requests must first adhere to the respective platform’s after-sales policies, including their specific return windows and shipping regulations.
- Holiday Season Extension: To ensure a better shopping experience during our peak season, the return and exchange window for orders placed between December and February of the following year will be extended to 60 days.
- Supplementary Terms: If the e-commerce platform’s policy does not explicitly address specific standards (such as product identification requirements or packaging integrity), the standards outlined in the "Eligibility Requirements" section of this policy shall apply.
3. Warranty Terms
(a) Warranty Period
- Coverage: All products, including the device and all add-ons, are covered by a 2-year warranty starting from the Warranty Start Date.
- Exclusions: Product packaging and promotional gifts are not covered by this warranty.
(b) Warranty Start Date Rules
- Online Purchases: The warranty period begins on the date of delivery (as recorded by the shipping carrier).
- In-Store / Offline Purchases: The warranty period begins on the date of purchase shown on the valid invoice or sales receipt.

(c) Warranty Statements for Replacements
For products that are exchanged, fully replaced, or have core components replaced due to quality issues (collectively referred to as "Replacements"), the warranty period is calculated as follows:
- Remaining Warranty Rule: If the original product is still within its warranty period, the Replacement inherits the remaining warranty period of the original product.
- 90-Day Minimum Extension: If the original product's remaining warranty is less than 90 days at the time of repair or replacement, the warranty for the Replacement will automatically be extended to 90 days, calculated from the date the repair is completed or the replacement is received (whichever provides the longer coverage).
- No Reset of Warranty: If a Replacement develops a defect (not caused by user misuse), its warranty coverage will be calculated based on the rules above. The issuance of a Replacement does not reset or restart the full 2-year warranty period.
- Terms of Coverage: The warranty scope, conditions for eligibility, and exclusions (e.g., what is not covered) for Replacements are consistent with the terms outlined in this policy for original products.
- Proof of Service: Customers must retain valid proof of the replacement or repair (e.g., service tickets, email correspondence) to serve as supplementary proof of warranty coverage. If you are unable to provide these documents, please contact Birdfy Customer Support for verification.
(d) Conditions for Free Warranty Service
To qualify for free warranty service, the following conditions must be met:
- Valid Defect: The product is currently within the specified warranty period, has been used normally, and exhibits a performance failure or defect that is not caused by user misuse or human error.
- Product Integrity: The product has not been subjected to unauthorized disassembly, modifications, or additions not explicitly guided by the official User Manual, and is free from any other faults caused by user misuse.

(e) Warranty Exclusions (What Is Not Covered)
The following situations are not covered by the Birdfy warranty service:
- Expired Warranty: Products or add-ons that have exceeded the 2-year warranty period.
- Invalid Proof: Failure to provide a valid proof of purchase or warranty card, or instances where the information on the receipt does not match the physical product.
- Improper Use & Mishandling: Damage caused by user misuse or improper handling, including but not limited to dropping, heavy impacts, crushing, liquid immersion, exposure to extreme heat, or component burnout caused by unstable voltage.
- Unauthorized Modifications: Defects caused by unauthorized disassembly, modification of the internal structure or core components, or the use of non-original Birdfy accessories/parts.
- Cosmetic Damage: Normal wear and tear or cosmetic damage—such as scratches, fading, or dents—that occurs during use and does not affect the product’s core functionality.
- Improper Environment: Damage resulting from use in environments that do not comply with the User Manual specifications (e.g., extreme temperatures, excessive humidity, or strong magnetic fields).
- Force Majeure: Damage caused by events beyond reasonable control (Force Majeure), including but not limited to natural disasters (e.g., rainstorms, lightning, earthquakes, floods), fire, war, or terrorist attacks.
- Unauthorized Channels: Products purchased from unauthorized dealers and second-hand markets.
- Altered Identification: Products where the identification label (e.g., QR code, Serial Number) has been altered, obscured, or damaged, rendering verification impossible.
- Shipping Damage: Secondary damage caused by improper packaging during transportation, and failure to report to the logistics provider and Birdfy in a timely manner.
- Other: Any other product issues or defects caused by abnormal use or non-standard operations.
4. Limitation of Liability
(a) Exclusive Remedy & Warranty Disclaimer

Exclusive Remedy: To the extent permitted by law, Birdfy’s total liability regarding the products is limited to the return, repair, or replacement services outlined in this policy. These remedies replace all other warranties, remedies, and conditions, whether oral, written, express, or implied.
- Birdfy specifically disclaims all implied warranties, including but not limited to warranties of merchantability and fitness for a particular purpose.
- If applicable law prohibits the disclaimer of such implied warranties, their duration shall be limited to the duration of the express warranty period specified in this policy.

No Liability for Indirect Damages: Birdfy is not responsible for any indirect, incidental, special, or consequential damages resulting from product failure, defects, or service delays. This exclusion applies to, but is not limited to:
- Loss of recorded data or footage;
- Interruption of birdwatching activities;
- Claims made by third parties;
- Loss of business opportunities or profits;
- Costs arising from equipment downtime or idleness.
- Liability Cap: Regardless of the legal theory on which a claim is based—whether in contract, tort (including negligence), or otherwise—Birdfy’s total cumulative liability to any consumer shall not exceed the original purchase price paid for the specific product. Liability is strictly limited to covering the costs of repair, replacement, or refund of the product itself.
(b) Explanation of Exemption Situations

Force Majeure: Birdfy shall not be liable for any failure to perform its after-sales obligations where such failure is caused by events beyond its reasonable control.
- Includes: Natural disasters, war, acts of terrorism, strikes, government mandates/embargoes, internet service interruptions, and logistics failures or paralysis.
- Notification: In the event of a Force Majeure occurrence, Birdfy will notify consumers via official website announcements or customer support as soon as reasonably possible.
- Consumer Non-Cooperation: Birdfy is not liable for any delays or inability to provide service caused by the consumer's own actions. This includes, but is not limited to, providing false product information, failure to cooperate with diagnostic procedures, or failure to respond to service notifications in a timely manner. Any additional losses or costs resulting from such actions shall be borne by the consumer.
- Illegal Use: Birdfy assumes no liability for any disputes, legal issues, or damages arising from the use of the Product in violation of local laws and regulations (e.g., unauthorized commercial surveillance or privacy violations).
(c) Exceptions to Liability Limitations
The following situations are not subject to the above liability limitations:
- Liability for bodily injury or death caused by Birdfy’s intentional misconduct or gross negligence.
- Liability for significant property damage caused by Birdfy’s intentional misconduct or gross negligence.
- Any other liability that cannot be excluded or limited under applicable law.

The updated policy shall prevail as publicly announced on the official Birdfy website, and no separate notice will be issued. Birdfy reserves the right of final interpretation of this policy.
