Collection and use of Personal Data

1. Personal Data

Birdfy collect information that you provide when setting up a Birdfy account. Such personal information may include information that can be used to identify and/or contact a natural person, such as name and email address. In addition to this, the information Birdfy collect also relates to your phone number if you have consented to our SMS service for you in the popup window or from the checkout.

If you contact Birdfy, Birdfy keep a record of your communication (Communication Content, e-mail address, contact telephone number, address, etc.) to help solve any issues you might be facing. Birdfy may use your email address to inform you about our services.

2. Use of Data

When you have access to our applications, Birdfy also collect certain device and network connection information such as IP address, device model, operating system version, unique device identifier, and mobile network information, as well as a running record of how long and how often you have used your device.

Birdfy also collect personal data when you visit our applications and use specific functions, such as creating and posting content using the applications, and Birdfy collect specific content that you post. In addition, Birdfy makes use of server logs, which process a record of your visits (when you visit the website and from which IP address). The purpose of these server logs is to help maintain the server and prevent malicious use (for example, blocking an IP address if it is the source of a DDOS attack.)

Do Not Track

Please note that Birdfy do not alter our Site’s data collection and use practices when Birdfy see a Do Not Track signal from your browser.

Your Rights

You have the right to access and update information about you, which you can do at any time in your account settings, and if you are unable to do this yourself, please contact us to assist you.

If personal data is incorrect or incomplete, Birdfy will endeavor to provide our customers with a quick way to update or delete it by contacting us as described in the section of this Privacy Policy entitled "Contact Information", and if you request deletion, please be aware that deletion does not necessarily delete all of your User Data on this server, but Birdfy guarantee that The retained user data will not be linked to your personal information. This may not be the case if the information must be retained for legal purposes.

Users have the right to withdraw their consent for the processing of Personal Data or the further processing of Personal Data by Birdfy at any time. A withdrawal should be sent to Birdfy at the contact information set out below.

2. Information on whether Birdfy disclose or sell personal data of CA residents

Summary:

In the preceding twelve (12) months Birdfy have not sold any personal information prior to the last update that had been made to this notice. Due to the fact that that under California law the term “sale” also includes disclosure of personal information in exchange for anything of value, the term “sharing” is also broadly defined and includes disclosures of personal information for personalized advertising which is based on a consumer’s information obtained from the consumer’s activity across non-affiliated websites. Since Birdfy use cookies and other online marketing tools that are offered to us by our partners, Birdfy might have shared your internet or other electronic network activity information or other browsing / marketing related information with our partners during the last 12 months as further disclosed below. Birdfy do not “share” or “sell” with third parties who are not acting on our behalf the personal information of individuals Birdfy know to be children as defined by applicable law.

Birdfy collect personal information from you and from the following categories of sources: our own sites, products and services, partner/affiliate sites, trough our affiliates or our promotional and strategic partners, social media sites, through other users submitting information about you, (such as inviting you to participate in an offering/sharing your feeder with you), publicly available sources.

In the last 12 months, Birdfy collected the following categories of personal information: personal and online identifiers, such as name, address, email address, online identifiers, IP address, account name, and similar identifiers., commercial and transactions information, such as records of products or services you obtained or considered and other information about your purchasing or consuming histories or tendencies, record-keeping information, such as financial information related to accounts and or past purchases you may have with us, internet or other electronic network activity information, such as your searches in relation to our products or keywords that are tied to our products as well as information about your interactions with our websites or the websites of our partners and your interactions with contextual ads that may be shown on our websites or the websites of our partners, demographic information/characteristics such as your age or, if you provide it to us, your gender identity, geolocation data, audio, electronic, visual, or similar information, such as photos, videos, and feeder recordings, sensitive personal information, such as your account credentials and employment-related information, inferences that may have been drawn from the above information about your predicted characteristics and preferences.

Due to the fact that that under California law the term “sale” also includes disclosure of personal information in exchange for anything of value, the term “sharing” is also broadly defined and includes disclosures of personal information for personalized advertising which is based on a consumer’s information obtained from the consumer’s activity across non-affiliated websites. Since Birdfy use cookies and other online marketing tools that are offered to us by our partners, namely, our affiliates, social media platforms, advertising partners, analytics partners and promotional partners, Birdfy might have shared the following information with such partners in the past 12 months: online identifiers, demographic information, commercial and transactions information, internet or other electronic network activity information; geolocation data, and inferences, such as audience segmentation.

In the past 12 months since the last update of this notice Birdfy have not shared any CA resident related data (such as geolocation data, audio, electronic, visual, or similar information) with international research entities.

Birdfy only disclose your personal data to third party processors/service providers in order to achieve the purposes of the processing activities described in sections 2, 3 and point 4.4 of this notice or when you have consented to such disclosure, whereby such third-party processors/service providers have concluded a data processing agreement with us (or offered similar safeguards) to ensure your rights are respected. A list of our third-party processors/or obtained by reaching out to us via the email or phone number listed at the end of this section.

Birdfy do not “share” or “sell” data to third parties who are not acting on our behalf any personal information of individuals Birdfy know to be children as defined by applicable law.

You have the right to request the disclosure of the categories of personal information Birdfy have collected from you, along with the categories of sources from which they have been collected, the purpose of their collection, the categories of third parties with whom Birdfy have shared your personal information (“Categories Report”), and the specific pieces of personal information that have been collected (“Specific Pieces Report”).

You may request that Birdfy disclose which personal information Birdfy have collected, used, shared, or sold in relation to you, and why Birdfy have collected, used, shared, or sold that information. Specifically, you may request that Birdfy disclose:

• The categories of personal information collected.
• Specific pieces of personal information collected.
• The categories of sources from which Birdfy have collected the personal information.
• The purposes for which Birdfy have used the personal information.
• The categories of third parties with whom Birdfy have shared the personal information.
• The categories of information that Birdfy sell or disclose to third parties.

Birdfy shall provide you this information for the 12-month period preceding your request. Birdfy shall provide you this information free of charge.

To request the above stated information, please send your request to hi@birdfy.com. Please allow 45 days for our response. For your protection and the protection of all of our users, Birdfy may ask you to provide proof of identity before Birdfy can oblige such a request.

Right to delete (i.e. request deletion of any personal information that Birdfy have collected from you).

After Birdfy have verified your request to delete your personal information, Birdfy shall delete it from our servers/records and direct any of our processors/service providers to delete your personal information from their servers/records, except when certain exemptions from the relevant parts of the CCPA are applicable (e.g. in cases where the personal information is necessary so that Birdfy may continue to provide our services), such as the continued training of our machine learning and bird recognition algorithms on your postcards / recordings (especially when they do not contain any personally identifiable information) and in order to detect security incidents, to identify and repair errors that impair existing intended functionalities of our products and services, to engage statistical research in the public interest.

If you are a registered user of one of our services, and you are under 18 years of age, you may have the right to request removal of content or personal information posted on our services by contacting us at hi@birdfy.com. Please note that Birdfy may not be able to completely prevent further use or disclosure of that content or information by others once you have shared the content publicly.

Right to opt out (of the sale of your personal information).

You may request that Birdfy stop selling your personal information, whereby this is currently not applicable as Birdfy do not currently sell any personal information.

Global Privacy Control (GPC) and Do Not Track (DNT) Signals

In compliance with the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), Birdfy recognize and honor Global Privacy Control (GPC) signals as a valid opt-out request for the sale or sharing of personal information.

GPC is a browser or device setting that allows users to automatically send an opt-out request to all websites they visit, without needing to manually opt out on each site.

When Birdfy detect a GPC signal from your browser, Birdfy automatically apply your opt-out preferences, meaning Birdfy will not sell or share your personal data unless legally required.

You do not need to take any additional action if GPC is enabled in your browser.

Do Not Track (DNT)

Do Not Track (DNT) is a browser setting that allows users to request that websites do not track their online activity. However, because there is no standardized industry response to DNT signals, Birdfy do not currently respond to DNT requests.

Instead, you can manage your privacy preferences by:

• Adjusting your cookie settings via our Cookie Policy page.
• Using GPC or other opt-out mechanisms available under California law.

The right to non-discrimination (when exercising your CCPA rights).

Birdfy will not discriminate against you in any manner prohibited by applicable law for exercising your CCPA rights (as listed above).

In addition to the rights already set out in this section, California residents have the right to correct inaccurate personal information Birdfy hold about them, and the right to limit our use and disclosure of sensitive personal information, in each case under the CCPA as amended by the CPRA. Birdfy do not sell personal data of any individuals, and Birdfy do not share personal information for cross context behavioural advertising as those terms are defined in the CCPA. Residents of other US states with comprehensive privacy laws in force have equivalent rights of access, correction, deletion, portability and opt out, and may exercise them by contacting us at hi@birdfy.com.
